預金保険国法銀行

預金保険国法銀行 (よきんほけんこくほうぎんこう Deposit insurance national bank DINB, 英語発音: [ˈdɪnbiː] DIN-bee[1])とは、アメリカ合衆国で銀行が破綻した際に連邦預金保険公社によって、グラス・スティーガル法および、1935年銀行法により一時的に設立される銀行である[2] 。

特徴[編集]

預金保険国法銀行はアメリカ通貨監督庁（英語版）により認可される。設立時、破綻銀行の付保預金を承継し、一時的に銀行サービスを顧客に提供する。[3] 預金保険国法銀行の権限は付保預金サービスに限られており、ブリッジバンクが可能な資産(貸出契約等)の承継や、非付保預金の受け入れはその地域の唯一の預貯金取扱金融機関でない限り認められていない。[2][4]

銀行は預金保険公社によって指名された経営者によって管理され、[3] 払い込み済みの株式資本を持つ必要はなく、[5] 取締役会を持たず[6] 連邦準備銀行の株式を保有する必要もない.[7]そのほかは、アメリカ国法銀行法に従う。[8]

預金保険国法銀行は2年まで存続可能であり[3]その地域の他の銀行に 買収されるか、資本を入れ恒久的な銀行にならない限り、2年以内の期限後に清算され、連邦預金保険公社に義務を引き継ぐ。[2]

日本では対応する法令は無いが、阪和銀行処理の際に設立された紀伊預金管理銀行が類似している。[9]

初の預金保険国法銀行は、Fond Du Lac State Bankがイリノイ州当局により1934年5月26日に閉鎖されたときに作られたDeposit Insurance National Bank of East Peoriaである [10][11]。1934年1月1日から、1935年8月23日の間に24の付保銀行を処理し、付保預金の払い戻しを預金保険国法銀行を通して行った。 [12]

預金保険国法銀行は、最初は預金保険公社が破綻処理のために可能な唯一の手段であったが、1935年銀行法において、預金保険国法銀行を設立せずにペイオフや 資産負債承継(Purchace and Assumption P&A) [13]をすることが認められてからはこの処理が行われることは大きく減り、銀行サービスが限られた分野や、即時払いができない場所に限られることになった。[10] 1975年に地元の黒人コミュニティに金融サービスを提供していた黒人の経営のSwope　Parkway National Bankや、アメリカ領バージン諸島で唯一の地元所有であったThe Peoples Bank of the Virgin Islandがその例で、預金保険国法銀行は、そのコミュニティに対し代替金融機関を創設する機会を与えるためにあった。[1]1935年から1998年までの間に預金保険国法銀行が設立されたのは5つだけであった。 [14]

最初は、預金保険公社は2023年のシリコンバレーバンクの破綻にDeposit Insurance National Bank of Santa Claraを設立して対処したが[15]、銀行の貸し出し構造の複雑さから、すぐにブリッジバンクのSilicon Valley Bridge Bank N.A.を作って付保、非付保預金をすべて移転し、買収しやすくした。[16][17]
